The organisation

Emission Claim is a nonprofit independent foundation that assists Dutch individuals who have purchased or leased a diesel car equipped with emission cheating devices in obtaining compensation. The foundation also aims to hold accountable automobile manufacturers that disregard environmental concerns.

Board of Directors

The foundation is governed by a Board of Directors and supervised by the Supervisory Board. The Board of Directors of Emission Claim is responsible for the (financial) policies and the implementation of the strategy aimed at achieving the statutory objectives.

Supervisory Board

The Supervisory Board oversees the policies and strategy of the Board of Directors and the overall operations of the foundation. Additionally, the Supervisory Board provides advice to the Board of Directors. 

None of the board members have a conflicting interest with the foundation, nor any interest that could jeopardize their independence.

Who are our lawyers?

Emission Claim Foundation has appointed the Amsterdam-based law firm Kennedy van der Laan to represent them in the Diesel Emission Cases.

Claim code compliance

The Emission Claim Foundation complies with the legal requirements of Article 3:305a of the Dutch Civil Code and the requirements of the Claim Code 2019. The Claim Code is a code for foundations and associations that are engaged in representing collective interests. The purpose of the code is to promote that the representative always prioritizes the interests of the affected parties.

  • What are the duties of the Board?

    The Emission Claim Foundation board is responsible for the policy and implementation of the strategy aimed at obtaining compensation. The board represents the foundation.

  • What are the duties of the Supervisory Board?

    The supervisory board oversees the policies and their implementation by the board and determines the strategy of the foundation. They assist the board and perform monitoring tasks as described in the "Claim Code 2019".

    Attorneys' fees are included in the success fee (maximum 25%) that the foundation is entitled to in case compensation is obtained.

Financial

  • Who is funding the cases against Renault, Mercedes and Stellantis?

    The Emission Claim Foundation is funded by Hagens Berman Sobol Shapiro LLP, a US litigation law firm experienced in suing companies for their wrongful acts. Hagens Berman is funding the proceedings and in return will receive up to 25% of the damages realised by the foundation. Any unclaimed amounts will be used in accordance with the foundation's statutory objectives.

  • Do the Directors and/or Supervisory Board members receive remuneration?

    Our board members receive a basic monthly allowance, as well as a compensation of €250 per hour for their services. They are also reimbursed for reasonably incurred travel, accommodation and meal expenses. With the exception of Steve Berman, who sits on the Board of Trustees on behalf of the funder, none of our board members has an interest that conflicts with that of the foundation or could compromise their independence. Mr Berman has waived the fees due to other board members.
